These Terms of Use ("Terms") govern your access to and use of ArcWave Proxy VPN ("App", "we", "us", or "our"), an Android application that provides VPN connectivity and related features. By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 13 years old (or the minimum age required by applicable law in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement and are legally allowed to use VPN services in your location.
You are responsible for ensuring your use of the App complies with all applicable laws, regulations, and platform policies.
ArcWave Proxy VPN provides device-level VPN tunneling and related network features on supported Android devices through Android's VpnService API. The App routes traffic through selected VPN servers to help provide secure connectivity.
Service quality may vary depending on device capabilities, network conditions, location, server load, and third-party infrastructure. We do not guarantee uninterrupted or error-free service.
You agree to use the App only for lawful purposes. You must not:

ArcWave Proxy VPN requires Android VPN authorization and uses permissions needed to run VPN foreground services and required notifications, as further described in the Privacy Policy. If required permissions are denied or revoked, some features may not function properly.
The App may integrate third-party services, including Google AdMob for advertising and Firebase Crashlytics for crash diagnostics, as described in the Privacy Policy. Third-party data handling is governed by those providers' own terms and privacy notices.
Where required by applicable law, non-essential processing (such as personalized ads and optional diagnostics) is enabled only after required notice and consent. You may update your choices via available in-app controls or by contacting us.
The App may rely on third-party SDKs, hosting providers, network carriers, and server operators. We do not control and are not responsible for the availability, performance, or policies of third-party services. Your use of such services may be subject to their own terms and policies.
The App, including software, design, trademarks, and related content, is owned by us or our licensors and protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, lawful, and non-commercial purposes.
To the maximum extent permitted by law, the App is provided on an "as is" and "as available" basis. We disclaim all warranties, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will always be available, uninterrupted, secure, or free from errors, or that it will meet your specific requirements in all environments.
To the fullest extent permitted by applicable law, we and our affiliates, officers, directors, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses arising from or related to your use of, or inability to use, the App.
Our total aggregate liability for claims under these Terms is limited to the amount you paid to us for use of the App in the 12 months before the claim, or zero if you made no payment.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless us and our affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your violation of applicable law or third-party rights.
We may suspend, restrict, or terminate access to the App if we reasonably believe there is a violation of these Terms, a legal or security risk, abuse of the service, or where required by law or platform policy.
You may stop using the App at any time by uninstalling it. Provisions that by nature should survive termination will remain effective, including intellectual property, disclaimers, limitation of liability, and indemnification.
We may modify, update, suspend, or discontinue parts of the App or these Terms from time to time. If material changes are made, we may provide notice through the App or other reasonable means. Continued use after changes take effect means you accept the revised Terms.
Your use of the App is also subject to our Privacy Policy, which explains how data is collected, used, shared, and protected. Please review that policy carefully.
These Terms are governed by applicable law, without prejudice to mandatory consumer rights that may apply in your jurisdiction.
If a dispute arises, please contact us first so we can attempt to resolve it informally in good faith.
If any part of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect. The invalid provision will be interpreted or modified to the minimum extent needed to make it enforceable where permitted by law.
These Terms, together with the Privacy Policy and any additional notices provided in the App, constitute the entire agreement between you and us regarding your use of the App.
